1. Introduction

Welcome to the Komorebi Institute, operated by Clive Witham. These Terms & Conditions ("Terms") govern all purchases of The EIM™ Gua sha Spoon: Saji. By placing an order, you acknowledge and agree to these Terms.

2. Product Information

  • ​The EIM™ Gua sha Spoon: Saji is handcrafted from high-fire stoneware clay and lead-free glazes in Spain. Due to its handmade nature, each piece is unique and may exhibit variations in size, shape, and color. These variations are inherent to the craftsmanship and are not considered defects.
  • ​​The EIM™ Gua sha Spoon: Saji is intended for personal or professional use as a Gua Sha tool. Handle with care due to its ceramic composition.
  • We guarantee the quality of all our products through stringent quality control processes. As a result, claims regarding defects in craftsmanship or materials will not be accepted. However, we address any damages that occur during transit or upon receipt under our policies.

3. Orders

  • ​All orders are subject to acceptance and product availability. We reserve the right to refuse or cancel any order at our discretion.
  • ​​Upon placing an order, you will receive an email confirmation. If there are any issues with stock or processing, we will notify you promptly.
  • Orders may not be altered or canceled after confirmation, except as permitted under applicable laws or these Terms.

4. Pricing

  • ​Prices are listed in USD and include applicable VAT (21%) for EU customers.
  • ​​Shipping fees are not included in the product price and will be calculated at checkout.
  • We reserve the right to modify prices at any time. Price changes will not affect orders already confirmed.

5. Payment

  • ​We accept payments via Credit Card and Apple Pay. Payment must be made in full at the time of purchase.
  • ​​All transactions are processed securely. We do not store or have access to your payment information.

6. Shipping

  • ​We ship worldwide using tracked shipping services via Correos.
  • ​​Shipping fees are calculated at checkout based on the destination and weight of the order.
  • Orders are dispatched within 3 business days of order confirmation. Delivery times vary depending on the destination.
  • Tracking information will be provided once the order is shipped.
  • Customers are responsible for any customs duties, import taxes, or other charges imposed by their local authorities.
  • Unfortunately, we are unable to ship to the following countries or regions:
  • ​North Korea
  • ​​Syria
  • Crimea (region in Ukraine)
  • Other regions under international trade sanctions or where logistical challenges prevent shipping (e.g., Antarctica).
  • ​Delivery to some remote regions may not be possible due to logistical constraints or carrier restrictions. If your destination falls within such areas, we will notify you promptly after placing your order and provide alternative options or issue a full refund.

7. Delivery Delays

While we strive to meet delivery timelines, we are not liable for delays caused by shipping carriers, customs processes, or unforeseen events outside our control.

8. Returns and Exchanges

  • ​Due to the handmade nature of the product, returns for reasons such as dissatisfaction with design or variations are not accepted.
  • ​​Exchanges are permitted if the item is unused and returned in its original condition and packaging. The customer is responsible for all shipping costs associated with exchanges. Please refer to our Refund Policy for detailed instructions.

9. Damages and Defects

  • ​If your item arrives damaged or defective, you must contact us at contact@komorebi-institute.com within 7 days of receipt.
  • ​​Include the following in your claim:
  • ​Clear photos of the damaged or defective item.
  • ​​Photos of the packaging (if relevant).
  • Order confirmation or receipt.
  • ​Approved claims will be resolved by either a replacement or a refund, as outlined in our Refund Policy.

10. Intellectual Property

All designs, branding, and related materials associated with The EIM™ Gua sha Spoon: Saji are the intellectual property of Clive Witham and the Komorebi Institute. Unauthorized copying, reproduction, or distribution is strictly prohibited.

11. Limitation of Liability

The Komorebi Institute is not liable for:

  • ​Improper use, handling, or care of the product, including any resulting injuries or damage.
  • ​​Any physical or emotional harm, allergic reactions, or other adverse effects arising from the use of the Saji spoon. Users are advised to consult a qualified professional if unsure about its suitability for their specific needs.
  • Losses resulting from delays, customs issues, or shipping carrier negligence.
  • Any indirect, incidental, or consequential damages, including but not limited to loss of income, profit, or data, arising from the use or inability to use the product.
  • Any claims or liabilities exceeding the purchase price of the product.

Customers use The EIM™ Gua sha Spoon: Saji at their own risk and are responsible for ensuring its appropriate and safe application.

12. Governing Law

These Terms are governed by the laws of Spain. Any disputes arising under these Terms will be resolved in the courts of Spain.
